easyTEK.technology, LLC-S ("easyFAX.technology")
Customers enter into a binding Customer Agreement with easyFAX.technology before using services. All offerings are subject to the Agreement, Terms and Conditions, and Privacy Policy. When customers select "I ACCEPT," they agree to be bound by these documents. The Agreement and Terms and Conditions represent the complete agreement between parties, though the Agreement may contain terms that supersede these conditions.
Customers may register online for easyFAX.technology services. During signup, easyFAX.technology verifies credit card information via a $0.00 authorization submission. Incomplete registrations authorize easyFAX.technology to contact customers to assist with completion, discuss offerings, answer questions, or communicate for other purposes.
easyFAX.technology may modify Terms and Conditions anytime by notifying customers via email. Continued service use indicates acceptance of revisions. Only written amendments signed by easyFAX.technology are valid modifications.
easyFAX.technology provides access to various fax and messaging services. All offerings, including updates, enhancements, and new features, remain subject to the Agreement, Terms and Conditions, and Privacy Policy.
easyFAX.technology may reduce message storage duration, limit message quantity, or remove storage and searchable features entirely. Customers accept that easyFAX.technology bears no responsibility for account failures, storage feature malfunctions, message deletion, service loss, or inability to retrieve messages. Customers assume complete responsibility for message content and third-party transmission/receipt.
If easyFAX.technology determines messages violate federal, state, or local statutes or breach the Agreement, it may decline transmission, remove messages, or deactivate service links without notice.
easyFAX.technology and its licensors wholly own all programs, numbers, services, processes, designs, software, technologies, trademarks, trade names, inventions, and materials comprising easyFAX.technology services. Customer use is non-exclusive and does not permit modification of source code or third-party modifications.
Customers cannot rent, lease, sublicense, alter, merge, modify, adapt, translate, decompile, reverse engineer, disassemble, or attempt to discover source code or structure. Customers cannot create derivative works or develop products with similar primary functions.
Customers do not own numbers assigned for service use. Ownership of any such number is vested solely in easyFAX.technology. easyFAX.technology is the customer of record and may reassign numbers immediately without liability for consequential damages. Customers waive any claims with respect to any such change or re-assignment.
easyFAX.technology does not review customer content and bears no responsibility for transmitted content or necessary consents. Customers bear responsibility for transmission accuracy and legal compliance, including HIPAA requirements. easyFAX.technology makes no representations regarding service availability or information accuracy/completeness.
All customers release and hold easyFAX.technology harmless from any person providing information using its services from any liability, cause of action, or claim related to the information transmitted. Healthcare treatment appropriateness decisions rest solely with healthcare providers.
Customers must acquire equipment and third-party services for access; maintain account security; be responsible for all charges, including unauthorized use before notification; and cannot sell, resell, rent, or lease service use.
Refer to the Privacy Policy for personal information protection details. easyFAX.technology may collect information during signup and service use to improve offerings and for diagnostic purposes. The company may disclose/sell aggregated, anonymized data.
Customer-transmitted personal information remains customer-owned and unaltered by easyFAX.technology. Information deletes per customer requests or easyFAX.technology's standard procedures.
Unless otherwise designated, messages store for approximately 60 days after receipt/transmission or until account termination, whichever occurs first. Stored messages are searchable by send/receive dates. Reports and customer information transmit within approximately 24 hours after service completion.
easyFAX.technology maintains administrative, technical, and physical safeguards protecting customer information security, confidentiality, and integrity. Customers acknowledge easyFAX.technology may change retention, storage, and protection practices anytime, with notification posted on the website.
easyFAX.technology has no responsibility or liability whatsoever for the deletion, loss, disclosure of, or failure to retain, store or protect any information.
easyFAX.technology does not guarantee website or service access. The company may temporarily suspend access without notice. easyFAX.technology will not be liable for any direct, indirect, incidental, special or consequential damages relating to any pranks, hoaxes, viruses, bugs or any other form of technological failure.
easyFAX.technology prohibits service/website use promoting illegal/fraudulent activities, including illegal drugs, pirated programs, weapons instructions, child exploitation material, violence, spam, and obscenity. easyFAX.technology determines prohibited use in sole discretion, with determinations being final, binding, and irrefutable.
easyFAX.technology may terminate service if determining prohibited content violates the Agreement or Terms and Conditions. Unlawful or violating information may be deleted without notice. easyFAX.technology reserves the right to remove any image or other information which violates its Agreement.
easyFAX.technology is not liable for unsolicited fax, email, text, or voice message claims, including Telephone Consumer Protection Act, FCC Rules, FTC regulations, Junk Fax Prevention Act, Can-Spam Act, and state law violations.
easyFAX.technology reserves the right to disclose information as necessary to satisfy applicable law, regulations, legal processes (subpoenas), or governmental requests. The company reserves rights to review customer information for Agreement compliance and legal requirement adherence upon complaint receipt.
easyFAX.technology retains rights to take actions deemed necessary if believing customer information creates liability, compromises services, or causes ISP/supplier service loss.
Customers agree to release, defend, indemnify and hold easyFAX.technology and its owners, officers, employees and agents harmless from any and all direct, indirect or consequential claims, losses, damages, judgments, expenses and costs.
easyFAX.technology's maximum liability for any occurrence or series, whether statutory, civil offense, breach of contract, or violation, shall not exceed amounts customers paid for the applicable service. In no way shall easyFAX.technology be liable for any damages caused to a customer or any third party.
Telemarketing phone calls, unsolicited fax advertisements, emails, and texts are federally and state-regulated. Violations using services are prohibited. If customers receive such communications containing unsubscribe contact information, customers may contact them.
Customers agree to release, indemnify, defend, and hold harmless easyFAX.technology, its owners, officers, employees and agents from claims, demands, and costs, including attorney fees, arising from customer-created electronic records, Agreement breaches, unauthorized service use, and customer negligence/misconduct violations.
Terms and Conditions are governed by and construed in accordance with the laws of the State of Colorado. Jurisdiction and venue for all disputes shall be in Denver, Colorado and will not be contested. Any right to a jury trial is expressly waived.
Customers may cancel services by contacting easyFAX.technology Customer Care. A representative assists with cancellation per easyFAX.technology's existing procedures. Termination becomes effective only after contacting and complying with procedures, with easyFAX.technology notifying of effective dates.
All customer data and information easyFAX.technology has on its platform (if any) may be permanently deleted by easyFAX.technology upon any termination. Ownership, data, warranty, liability limitation, and indemnification sections survive termination.
easyFAX.technology bears no responsibility notifying third parties of suspension, restriction, or termination. Upon such events, easyFAX.technology shall have no obligation to maintain any messages, information or other content or forward unread/unsent materials. A termination shall not relieve a customer from any amounts owing or any other liability.
If any provision becomes invalid under applicable laws, invalidity does not affect other provisions.
The Agreement, Terms and Conditions, and Privacy Policy constitute the sole agreement regarding services and subject matter. No oral or written representations outside these documents bind any party. easyFAX.technology waiver of any right does not constitute waiver of other rights.
easyFAX.technology reserves the right to assign, transfer or delegate any rights and/or obligations hereunder, in part or in whole, without prior consent. Customers cannot assign rights/obligations without easyFAX.technology's written consent. Documents bind parties and successors.
Any action, demand or claim against easyFAX.technology must commence within one year of origination or be forever waived. Printed/electronic Agreement versions are admissible in proceedings as original business documents.
To protect customer privacy and comply with the Electronic Communications Privacy Act 18 U.S.C. Section 2701 et seq., ALL document/information requests require written customer consent or valid civil subpoena from courts with proper jurisdiction.
easyFAX.technology reserves the right to request complaint copies and supporting documentation demonstrating requested document/information relevance.
Upon valid subpoena receipt, easyFAX.technology may notify affected customers allowing reasonable time to quash subpoenas or respond. The Electronic Communications Privacy Act prohibits easyFAX.technology from disclosing electronic communication content via civil subpoena.
Upon valid requests, easyFAX.technology conducts searches for responsive documents/information on its system. easyFAX.technology only keeps customers' documents and information for a limited period of time.
easyFAX.technology will require a minimum $250.00 reimbursement for the reasonable costs incurred in processing written requests and responding to subpoenas for documents and information.
easyFAX.technology reserves the right to object to vague, overly broad, or unduly burdensome requests or subpoenas.
The Junk Fax Protection Act establishes sender responsibility for opt-out notice compliance and liability for violations. Customers may voluntarily elect third-party opt-out request retention. easyFAX.technology offers this ancillary service automatically at no charge. Per the Act, third parties need only accept/forward do-not-fax requests and bear no responsibility or liability.
